1. Acceptance of Terms

By accessing or using PaddleDraw ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and PaddleDraw ("we," "us," or "our").

We may update these Terms from time to time. Your continued use of PaddleDraw after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

2. Account Registration and Responsibilities

To use certain features of PaddleDraw, you must create an account using email/password, Google, or Facebook sign-in. When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration and keep your profile up to date.
  • Maintain the security of your account credentials. You are responsible for all activity that occurs under your account.
  • Notify us immediately if you suspect unauthorized access to your account.
  • Not create multiple accounts for the purpose of circumventing suspensions, bans, or registration limits.

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's consent to use the Platform.

3. Event Registration and the Platform's Role

PaddleDraw is a platform that connects pickleball event organizers with participants. We facilitate event discovery, registration, and communication. It is important to understand the following:

  • Organizers are independent individuals or organizations who create and manage events on PaddleDraw. They set the rules, schedules, pricing, and policies for their events.
  • PaddleDraw is not the organizer of any event listed on the Platform. We do not control the content, quality, safety, or legality of events, nor the accuracy of event listings.
  • Registration — when you register for an event, you enter into a relationship with the event organizer, not with PaddleDraw. Any disputes regarding event logistics, refunds, or conduct should be directed to the organizer.
  • Fees and payments — event fees, if any, are set by the organizer. PaddleDraw may facilitate payment processing but is not responsible for refund policies, which are determined by the organizer.

4. User Conduct

You agree not to use PaddleDraw to:

  • Violate any applicable law, regulation, or third-party rights.
  • Post or transmit content that is fraudulent, misleading, defamatory, obscene, or otherwise objectionable.
  • Harass, threaten, or intimidate other users, organizers, or participants.
  • Misrepresent your skill level, identity, or affiliation with any person or organization.
  • Interfere with or disrupt the Platform, its servers, or connected networks.
  • Scrape, crawl, or use automated means to access the Platform without our prior written consent.
  • Attempt to gain unauthorized access to other user accounts, systems, or data.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions, including removing content, suspending or terminating accounts, and reporting to law enforcement.

5. Intellectual Property

The PaddleDraw name, logo, website design, and all original content, features, and functionality are owned by PaddleDraw and are protected by copyright, trademark, and other intellectual property laws.

By posting content on PaddleDraw (such as event descriptions, profile information, or images), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the Platform. You retain ownership of your content and may remove it at any time.

You may not copy, modify, distribute, or create derivative works based on PaddleDraw or any of its content without our express written permission.

6. Limitation of Liability

PaddleDraw is a technology platform that connects organizers and participants. To the fullest extent permitted by applicable law:

  • No responsibility for events — we are not liable for any injury, loss, damage, or dispute arising from your participation in any event listed on the Platform. Participation in pickleball events carries inherent physical risk, and you assume that risk voluntarily.
  • No warranties— the Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Limitation of damages — in no event shall PaddleDraw, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.
  • Maximum liability — our total aggregate liability to you for any claims arising from your use of the Platform shall not exceed the amount you have paid to PaddleDraw (not to event organizers) in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

7. Indemnification

You agree to indemnify, defend, and hold harmless PaddleDraw and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

8. Termination and Suspension

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or third parties, or is otherwise inappropriate.

You may delete your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, limitation of liability, indemnification, and dispute resolution.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Platform at least fourteen (14) days before the changes take effect. Your continued use of PaddleDraw after the effective date of revised Terms constitutes your acceptance of those changes.

If you do not agree to the modified Terms, you must stop using the Platform and delete your account.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PaddleDraw operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through binding arbitration or in the courts of competent jurisdiction, as permitted by applicable law.

11. General Provisions

  • Entire agreement — these Terms, together with our Privacy Policy, constitute the entire agreement between you and PaddleDraw.
  • Severability — if any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver — our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • Assignment — you may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
